How Does Kentucky Law Define Wrongful Death?

Wrongful death claims are a special type of personal injury claim that involves the loss of life. A typical personal injury claim seeks to recover compensation for an accident victim.  For example, if a reckless driver injures you, you file a personal injury claim to recover damages such as medical expenses, lost income, emotional stress, and physical pain. However, a wrongful death claim seeks to recover compensation for the survivors who lose a loved one in an accident. Losing a loved one because of any reason is tragic; however, when that death is preventable, it can be extremely difficult to process. When another person or entity causes a death, it may be possible to hold that party responsible and accountable under Kentucky’s wrongful death laws. Because a wrongful death action can be one of the most difficult types of personal injury claims to handle, it is crucial that you hire an experienced Louisville wrongful death attorney as soon as possible to represent you and your family. What Evidence Is Used In A DUI Accident Case?

As discussed in one of our previous blogs about DUI accidents during the holidays, we anticipate an increase in DUI incidents in Kentucky throughout the holidays. Alcoholic beverages are a part of the holiday celebrations for many individuals. For some, spiced cider or rum eggnog during the holidays is a staple.  However, there are individuals who will over-indulge during the holidays. If those individuals choose to drive after consuming alcohol, the results can be tragic. If you are injured in a DUI accident, it is important that you take steps to protect your legal right to recover compensation for your injuries. A conviction of drunk driving or other criminal charge does not guarantee you will receive compensation from the drunk driver’s insurance company. We urge you to contact our office at 888-761-7204 to discuss your legal options with an experienced Lexington DUI accident attorney. […]

Kentucky DUI Accidents During The Holidays

As we enter the holiday season, it is important to remind everyone of the dangers of drinking and driving. DUI accidents claim thousands of lives each year. During the holidays, drunk driving accidents increase, beginning with Blackout Wednesday. What Is Blackout Wednesday? Blackout Wednesday is the unofficial name given to Thanksgiving Eve. This day is known by bartenders and law enforcement officers throughout the United States as one of the biggest drinking days of the year, even surpassing New Year’s Eve and July Fourth in some areas. The reason why more people drink to excess the day before Thanksgiving is unknown. Some experts believe it is because many people are off on Thanksgiving Day so they know they can consume alcohol in excess without worrying about going to work the next day. […]

The Insurance Company Says I Am At Fault For The Accident, Can I Still Win?

A common tactic insurance companies like to use in motor vehicle accidents is blaming the victim. In some states, if the accident victim is partially to blame for the accident, he or she is unable to recover any damages from the other driver. Thankfully, Kentucky does not operate under this legal theory. […]

Why Is My Health Insurance Company Wanting Me To Pay It Back From My Accident Settlement?

This is a common question our Louisville car accident attorneys hear from many of our clients. The short answer is that your insurance policy has a subrogation clause buried in the fine print. Your insurance agent or employer probably did not explain this clause to you. Therefore, if you have never been injured in an accident until now, you have not had any reason to deal with this clause. However, this one clause can complicate your accident settlement, especially if you are attempting to handle the accident claim without an attorney. […]
